Jennifer Martin (Partner-Dallas, TX) and Timothy Delabar (Associate-Dallas, TX) obtained affirmation of a motion to dismiss in the Fifth Circuit Court of Appeals on behalf of an insurance company. The plaintiff alleged the firm’s client denied his claim for storm damage to his home in bad faith and was engaged in a fraudulent scheme to systematically deny claims. After the district court granted a motion to dismiss under Rule 12(b)(6), the plaintiff asked the district court to reconsider its dismissal and appealed the dismissal to the Fifth Circuit. Jennifer and Tim successfully opposed the motion for reconsideration at the district court and convinced the Fifth Circuit to uphold the district court’s decision. As a result, the Fifth Circuit issued an unpublished order affirming the order of dismissal in all aspects and securing a complete victory on behalf of the firm’s client.
