Nick Martin (Partner-San Francisco) and San Francisco Of Counsel Yakov Wiegmann and Kendra Tietjen obtained summary judgment for the firm’s new biopharmaceutical client in a talc litigation matter set for trial in early May. The plaintiffs had alleged that the decedent developed cancer from decades of use of various cosmetic products, including a name-brand powder. The team established, as a matter of law, that our client was not liable for the alleged acts of its former subsidiary, which manufactured and marketed the disputed product. The Superior Court of California, County of Los Angeles, Civil Division agreed that plaintiffs could not pierce the corporate veil and hold the shareholder liable for the acts of an actual allegedly responsible entity. Judgment has been entered in favor of the client, and the trial will now proceed against other defendants. Our client recently transferred 48 talc litigation matters to Wilson Elser, and this motion was the first significant contested event.
