Daniel McLeod (Associate-Orlando, FL) obtained summary judgment in Orange County Circuit Court on behalf of a maintenance services provider and mall operator in a slip-and-fall action. Daniel argued the plaintiff failed to present competent evidence that would permit a reasonable jury to conclude the defendants had actual or constructive knowledge of the spill at issue, as is required by Florida statutes. Instead, the evidence presented by the plaintiff relied on the impermissible stacking of inferences and conjecture. The court agreed with the argument and granted final judgment on behalf of the firm’s clients just 10 days before trial was set to begin.
