Jonathan Meer (Partner-NY) and Kerry Ayala (Associate-NY) defended a large nonprofit association that provides care and accommodations to individuals with disabilities in an action before the New York State Division of Human Rights. The plaintiff alleged that our client engaged in unlawful discrimination in employment based on race, national origin and retaliation. Jonathan and Kerry successfully demonstrated to the Division during its investigation that the firm’s client had a legitimate basis to terminate the plaintiff’s employment. The investigation found that there was no evidence supporting the allegation that the association’s conduct was motivated by a discriminatory animus. Instead, the investigation documented that the termination was based on gross insubordination. It further found that there were no comparably situated employees identified of a different race or national origin who were accused of similar actions and not terminated. In issuing the No Probable Cause Determination, the Division found no evidence of a connection between the claimant’s protected class and our client’s decision to terminate her.
