Jeremy J. Nelson (Associate-Louisville, KY) obtained summary judgment on behalf of a gas station/convenience store owner in a premises liability lawsuit filed in Henry Circuit Court, Kentucky. The plaintiff alleged she tripped and fell over a non-slip safety mat adjacent to a self-service beverage station inside the store, sustaining extensive injuries. Video footage of the event showed that, upon reaching the beverage station, the plaintiff milled about the area for around two minutes, stepping on and off the safety mat eight times without incident, but fell on her ninth trip across the mat. The area of the mat over which the plaintiff tripped is clear throughout – the mat was flat on the ground and she dragged her foot, pulling the mat up as she stepped onto it with her other foot. Jeremy moved for summary judgment, arguing, as a matter of law, that a properly placed safety mat is not dangerous. The plaintiff argued the very existence of a dispute concerning the mat’s condition created a genuine issue of material fact sufficient to defeat summary judgment. In response, Jeremy pointed out that plaintiff’s dispute, while centered on the material fact of the mat’s condition, was not genuine. In light of the objective and observable reality of the mat’s condition, as seen in the video surveillance, any dispute in that regard could not be genuine. The court agreed with Jeremy and granted summary judgment.
