Camille E. Shora (Of Counsel-McLean, VA) obtained summary judgment for a general contractor in Raleigh County, West Virginia. The client built a classic-car showroom for the plaintiff, who then sued our client and two other subcontractors after scratches were discovered on the showroom windows. Plaintiff claimed a manufacturing or installation issue resulting in the scratches, which damaged the UV coating of the windows and, in turn, caused damage to the displayed cars. Plaintiff turned down a settlement offer a week before the summary judgment motions hearing. At the hearing, plaintiff’s counsel admitted that plaintiff had no facts to support three of the five counts asserted against our client and the other defendants, and thus could not overcome the defense arguments for the breach of contract, product liability and misrepresentation claims. After Camille’s arguments on the express and implied warranty claims, the court granted our motion for summary judgment, dismissing the entire case.
