Parks Stone (Partner-Atlanta, GA) and Eleanor Jolley (Of Counsel-Atlanta, GA) successfully defended the firm’s probation company client sued under theories of professional liability when one of its employees, a probation officer, engaged in sexual relations with an assigned probationer. The plaintiff alleged a variety of negligent hiring, supervision, retention and vicarious liability claims. The Forsyth County Superior Court agreed with Parks and Eleanor’s arguments that our client did not and could not foresee the officer’s propensity to engage in sexual misconduct, and granted summary judgment on all counts.
