Tractor Trailer Roll Over Case Dismissed Based on Worker's Compensation Bar

New York/White Plains office succeeded on appeal in affirming the dismissal of a serious personal injury case - Guy Levasseur (Partner-WP) and Judy Selmeci (Of Counsel - NY) won an appeal at the Appellate Division, Second Department in a New York case involving a tractor trailer roll over/overloading claim presenting significant seven figure exposure, (the primary and excess insurers agreed the case value, assuming liability was in excess of $2.5 million, as the forty four year old plaintiff suffered multiple fractures, and was left crippled and permanently unable to work. We successfully argued that since the plaintiff worked for a related company and had received worker’s compensation benefits from a parent company the worker’s compensation statute should bar his claim.
