Rebecca Young (Of Counsel-Birmingham, AL) won a second summary judgment for a commercial bus company and its driver. Last year, multiple individuals filed lawsuits following a tire blowout accident that resulted in various injuries and hundreds of thousands of dollars in medical expenses. Rebecca obtained a summary judgment by arguing that the plaintiffs could not demonstrate that the defendant did something or failed to do something that caused the accident. In a different case arising out of the same accident, the plaintiffs conceded there was no evidence showing the tire blowout was caused by the client bus company or its driver. Rather, the plaintiffs argued that their injuries were caused by our client’s failure to maintain the interior of the bus, and specifically that the bus had defective seats with "exposed metal" and no seat belts. Rebecca argued that the plaintiffs did not demonstrate that the seats caused their injuries and the court agreed, granting the defendants judgment as a matter of law on all claims.
