Lateral Partner Joins Wilson Elser’s Appellate Team in New York

Nolan P. Comfort focuses his practice on cybersecurity and data privacy, as well as a range of general and complex liability matters. A member of the firm’s Cybersecurity & Data Privacy Practice, Nolan advises clients in connection with actual or suspected cybersecurity incidents and data breaches, ranging from email compromises to sophisticated ransomware attacks. He is a member of the firm’s 24/7 incident response team for private and public companies spanning all industry sectors, counseling clients on their legal obligations under U.S. data privacy and breach notification laws and assisting them in devising crisis communication strategies.
In addition to his cybersecurity and data privacy work, Nolan handles a broad range of general and complex liability matters, including premises liability, defense of veterinary malpractice claims, and construction and transportation disputes in New York state and federal courts. He reviews and responds to comprehensive discovery demands, conducts and defends depositions, and drafts affirmative and responsive motions.
Nolan joined Wilson Elser from the New York office of a full-service AmLaw 100 law firm with offices across the United States. He previously served as Assistant Corporation Counsel at the New York City Law Department’s Tort Division, where he handled a rotating caseload of high-exposure cases from commencement through resolution. His responsibilities included assessing and identifying risk and liability and proposing litigation strategies on behalf of the City and its agencies. Nolan also previously worked as a Staff Attorney at the Legal Aid Society of New York City, where he handled all aspects of civil litigation, including trials and settlement negotiations.
Nolan has been involved in several organizations dedicated to protecting the rights of the LGBTQ+ community. He was the Committee Chair of the Lesbian, Gay, Bi-sexual, Transgender, Queer, and Ally Committee of the New York City Law Department, and was a member of his law school’s LGBT Pro Bono Society. Nolan presently serves as a member of the LGBT Bar Association of New York.
New York, New York, partners Kristen Carroll, Nolan Comfort and Ellen Greiper obtained unanimous affirmance of an order from Bronx County that granted our motion for summary judgment dismissing the complaint on the grounds that the plaintiff did not sustain a “serious injury” under any category of Insurance Law § 5102(d), in a case where summary judgment was already granted to the plaintiff on liability in a rear-end accident. The court held that Kristen, Nolan and Ellen met their prima facie burden through the submission of an expert report from an orthopedic surgeon who found normal ranges of motion with no evidence of acute injury, and that any injuries were degenerative in nature and not causally related to the accident; and a biomechanical engineering expert who opined that the low impact could not have caused the plaintiff’s claimed injuries. The plaintiff’s deposition also was submitted, wherein he admitted he ceased treatment within eight months of the accident. The court held that plaintiff’s failure to explain his cessation of treatment interrupted the chain of causation and rendered his physician’s finding of permanency speculative. Finally, the court held that the team met our burden with respect to the 90/180 category, as the plaintiff testified that he was only out of work for six weeks after the accident and continued to work at least 40 hours a week in his same capacity as a signal maintainer with the MTA within a few months of the accident.
