Stratton Horres (Senior Counsel-Dallas, TX) and Karen L. Bashor (Partner-Las Vegas, NV) co-authored “Handling High-Stakes Litigation: Why Early Resolution – Not Winning at Trial – Should Be the Goal in Bet-the-Company Cases” for the June 2022 edition of CLM Magazine. The increase in catastrophes is leading to a rise in bet-the-company litigation (BTCL), which is any legal action that threatens the existence of a company or business. Stratton and Karen write that early resolution of BTCL can help save a company’s reputation by avoiding a cascading series of mini-catastrophes that inevitably arise from a larger occurrence. They stress the importance of a coordinated legal strategy that involves collaboration between in-house and outside counsel, insurance companies and a public relations effort to assess the situation and avoid any missteps. Most importantly, resolving BTCL requires non-traditional defense strategies to help the team gain leverage in a path to resolution before trial.
