According to the authors: “Jurisdictional disputes in Latin America are a challenge for parties and courts alike. These battles are incentivized by each country’s interests and the differing available legal causes of action with varying remedies. This continues to be the major driving force for these disputes. While strides have been made in some areas – particularly in the assertion of local jurisdiction and the refinement of forum non conveniens – there is still much work to be done.”
