Jennifer and Tim discuss the Texas Court of Appeals Seventh District interpretation of whether parties can send a notice letter designed to discourage settlement. “Whether this will have the desired effect – encouraging plaintiffs’ attorneys to be reasonable in their pre-suit demands – or instead encourage them to lobby the legislature to amend Chapter 542A remains to be seen.” The authors note, “But in the short term, the legislative goal of encouraging settlement will likely be reached as the inability to recover attorney fees will almost certainly encourage plaintiffs to seek early settlement.”
