Melissa C. Terranova (Associate-Madison, NJ) and Maxwell L. Billek (Partner-Madison, NJ) collaborated on “The High Price of a Sleepless Night: Monetizing ‘Nighttime Companionship’ in Wrongful Death and Medical Malpractice Cases,” which appeared in the May 19, 2025, posting of New Jersey Law Journal. New Jersey’s wrongful death statute (N.J.S.A. 2A:31-1) reflects an ongoing judicial struggle: How to compensate for deeply human, emotional losses, such as companionship and guidance, without crossing into the prohibited territory of grief and anguish. The authors conclude: “Ultimately, the attempt to assign an hourly rate to “nighttime companionship” in wrongful death and medical malpractice actions is not only legally tenuous but also intellectually dishonest. … This valuation exercise collapses under its own weight; it conflates presence with service, love with labor, and intimacy with utility. Courts should remain vigilant against such reductive theories, which stretch beyond the boundaries of established law and distort the purpose of pecuniary recovery.”
