Taylor Bialek focuses on intellectual property, internet law, privacy law, and commercial litigation, handling transactional and litigation matters for clients ranging from established businesses to emerging companies. She counsels clients in domestic and international markets on all aspects of trademark and brand protection, including portfolio development, clearance, prosecution, maintenance, and enforcement, helping them coordinate global trademark strategies and build, protect, and grow their brands worldwide.
Taylor also counsels clients on online compliance, performs website and social media audits, and prepares the full suite of internet-related legal documents necessary for businesses operating in a digital environment. She has experience in data and privacy law, including health- and biometric-related privacy regulations. She also has considerable experience conducting complex e-Discovery and has handled a wide variety of litigation matters in state and federal courts, as well as in arbitration proceedings.
Taylor is an active member of the firm’s Israel Practice and Asia Practice. She is also actively involved with the firm’s Women Attorneys Valued & Empowered (WAVE) initiative, which exemplifies the firm’s approach to advancing the professional and personal well-being of women attorneys.
Intellectual Property
Taylor handles a variety of intellectual property matters involving copyrights, trademarks, trade secrets, rights of publicity, and rights of privacy. As a litigator, Taylor effectively resolves intellectual property-related actions, defending against infringement claims. She also manages domestic and international trademark portfolios, assisting clients with trademark prosecution and enforcement.
Trademark & Brand Protection
Taylor counsels clients on every phase of trademark portfolio development and brand strategy, working to enhance growth and mitigate risk in domestic and international markets. She conducts clearance searches and advises on the availability of trademarks and service marks, prepares and prosecutes applications for registration with the United States Patent and Trademark Office (USPTO), and coordinates with trusted foreign counsel on international trademark filing and prosecution strategies worldwide. Taylor handles all aspects of trademark maintenance, including monitoring deadlines and renewing registrations across multiple jurisdictions. She also designs and implements comprehensive trademark enforcement strategies. In addition, Taylor advises clients on domain name matters, including acquisition and enforcement strategies and Uniform Domain Name Dispute Resolution Policy (UDRP) proceedings.
Internet Law
Taylor counsels the firm’s clients on online compliance, helping businesses navigate the legal complexities of operating in a digital environment. She performs proactive, detailed website and social media audits to identify potential legal risks, including use of infringing materials and compliance with state and federal laws. She prepares the full suite of internet-related legal documents, including terms of use and user agreements, privacy policies, terms of sale, and accessibility statements. She also advises clients on intellectual property-related issues arising in the online space, including protecting digital content and negotiating rights protection and transfer agreements. In addition, Taylor prepares social media policies that help ensure online communications are compliant with applicable law and consistent with company messaging. On the litigation side, she defends against claims involving website accessibility and compliance with the Americans with Disabilities Act (ADA) and similar state statutes. She also handles disputes arising from internet-related communications and digital media.
Data & Privacy Law
As a member of the firm’s Cybersecurity & Data Privacy Practice, Taylor evaluates website compliance with state, federal, and international privacy laws, prepares privacy policies, and consults regarding compliance with health and biometric information privacy laws. She works proactively with clients to ensure their online platforms and digital practices comply with evolving state, federal, and international privacy regulations, helping businesses stay ahead of the rapidly changing legal landscape. On the litigation side, Taylor has experience defending against claims arising under the California Invasion of Privacy Act (CIPA), including actions alleging unlawful recording or interception of communications through website technologies and chat features. She also handles litigation involving phone-home software, defending clients against claims that software applications transmit user data without proper notice or consent. Taylor’s combined counseling and litigation experience in this area allows her to advise clients on practical compliance strategies informed by an understanding of the risks and trends driving privacy-related litigation.
Commercial Litigation
An active litigator, Taylor handles matters in state and federal court, as well as in arbitration proceedings. She has experience handling a wide variety of litigation matters, including those involving intellectual property infringement, breach of fiduciary duty, misappropriation, corporate waste, directors and officers liability, product liability, property damage, false advertising, civil Racketeer Influenced and Corrupt Organizations Act (RICO) claims, and class actions.
