Jarad Kent (Partner-Tyler, TX/Dallas), and Morgan Wood (Of Counsel, Tyler/Dallas) secured a complete voluntary dismissal in the 293rd District Court, Dimmit County, Texas, for their clients, a large commercial truck tire dealer and a retread manufacturer, following an automobile accident. The plaintiff and the intervenor in this matter allegedly sustained serious injuries as a result of their vehicle striking trailer tires that had become dislodged and lay in the roadway. Wilson Elser moved for summary judgment, arguing that there was no evidence establishing our client's negligence and that significant issues remained in proving causation. On the eve of the deadline to respond to the motion, counsel for the plaintiff and counsel for the intervenor both elected to dismiss their clients' claims against Wilson Elser's clients.
