Lynsie Gaddis Rust Partner

Lynsie Gaddis focuses her litigation practice in general civil defense, with an emphasis on tort defense, commercial disputes and trial advocacy.

Areas of Focus

Tort Defense & Insurance Coverage
Lynsie is seasoned in the areas of premises liability, product liability, medical malpractice, trucking and transportation claims, and in the defense of other complex personal injury claims, including wrongful death. She regularly defends entertainment and hospitality companies in connection with injuries to patrons and represents insurers with regard to coverage disputes and claims of bad faith.

Commercial Litigation
Lynsie’s commercial litigation experience includes advising corporations and individuals regarding pre-litigation business disputes in an effort to avoid the expense and risk of the court system. She also regularly litigates claims involving breach of contract, LLC and shareholder disputes, tortious interference with business relations and fraud claims. Lynsie has litigated a number of these complex commercial matters to trial, including one arbitration and one bench trial that both resulted in lucrative awards to the corporate entity she was representing.

Lynsie has also arbitrated a number of cases involving commercial disputes and healthcare issues. She has participated in one bench trial involving fraud in the inducement/breach of contract claims centered on the sale of oil and gas leases, which resulted in a multimillion-dollar judgment in favor of her client, a Colorado-based venture capitalist company.

Professional Liability
A hybrid of her tort defense and commercial litigation experience, Lynsie also regularly defends professional liability claims, with an emphasis on the representation of insurers and accounting firms.  Specifically and with regard to defending accountants in malpractice suits, she has defended claims by third-party users of accounting firm services involving claims such as audit failures, security laws claims, failure to detect embezzlement and fraud, providing allegedly faulty tax or estate planning advice, and improperly valuing businesses.

Workers' Compensation
Lynsie handles a range of compensation defense issues for insured and uninsured employers, including workers’ compensation appeals. She also counsels on steps that can be taken to reduce risk and avoid penalties.

General Litigation
While Lynsie’s civil litigation practice focuses on tort defense and commercial disputes, she is routinely brought in on other types of litigation when a trial is imminent. Lynsie’s vast trial experience includes jury trials involving catastrophic trucking accidents, First Amendment issues (defamation and false light), subrogation claims, premises liability, wrongful use of civil proceedings, claims under Kentucky’s Whistleblower Act and workers’ compensation retaliation.
