David and Matt discuss cases that demonstrate the scope of the recall remedy: “The trend appears to be that businesses implementing a comprehensive recall system will be protected against post-recall class actions where the plaintiffs have not taken advantage of the remedy or do not allege an injury different than what the remedy would resolve. Even if plaintiffs are able to establish injury and causation to avoid challenges to standing or mootness challenges, they still must demonstrate that a class action is the superior method to resolve the matter at the class certification stage.”
