Larry Lum (Partner-New York City) and Jessica Woodhouse (Associate-New York City) secured a unanimous defense verdict on behalf of the firm’s New York City casino client on the issue of liability before Judge Alison Taylor in the Supreme Court of the State of New York for Queens County. The plaintiff, a 40-year-old woman, slipped and fell on the dance floor at the casino, resulting in a trimalleolar ankle fracture that required open reduction/internal fixation and a subsequent surgical procedure. The plaintiff claimed she fell on liquid that was permitted to remain on the dance floor for at least 20 minutes before her accident. However, the casino’s security/EMT officer who spoke with plaintiff at the scene noted on the incident report that plaintiff stated she rolled her ankle while dancing, with no mention of a liquid condition. The officer was no longer employed by the casino at the time of trial and was reluctant to testify. He eventually appeared under subpoena and laid the necessary foundation for the jury to hear what plaintiff said contemporaneous with the accident. The plaintiff demanded $750,000 prior to the verdict. The jury deliberated for approximately 50 minutes before unanimously finding no negligence on the part of the casino.
