Larry Lum (Partner-NYC) and Jessica Woodhouse (Associate-NYC) secured a unanimous defense verdict on behalf of a casino after a week-long trial in Supreme Court, Kings County. The plaintiff, a 70-year-old man, tripped and fell over what his counsel alleged was a torn, improperly secured, uneven carpet; counsel also alleged various building code violations. Larry and Jessica used photos taken by the plaintiff and his lawyer, and that were attached to the accident report, to show that the carpeting had no bumps, was not loose and that the picture of the so called tear (actually a seam) was not what caused plaintiff to fall. They submitted that plaintiff was caused to fall by the beginning of an incline in the walkway that he failed to see or appreciate because he was looking at his phone. Despite questionable rulings made by the Judge (such as charging the jury on inapplicable code violations and consistently sustaining objections to proper questioning of defense witnesses on our direct examination), the jury returned a unanimous defense verdict after 20 minutes of deliberation.
