Las Vegas partners Mark Severino and Jorge Ramirez obtained a defense verdict in Clark County Court, Nevada, despite their client having admitted fault for rear-ending the plaintiff, who sued the client for causing the accident and his injuries. At his deposition, the plaintiff recanted and said it was the client’s ex-wife driving, not the client, but never moved to amend the complaint. The ex-wife also was an insured under the policy, so while there was a liability defense, their insurer offered to accept liability and just try damages. During the opening statement, we conceded liability and indicated the case would be about damages, but in his case-in-chief, the plaintiff decided to make liability an issue. He testified that it was our client’s ex-wife driving the car and she, not our client, caused the accident and his injuries. When our client was called to testify, he consistently testified that he was driving the car. In an effort to enrage the jury, plaintiff’s counsel accused the defendant of lying and committing perjury. Given the way the plaintiff emphatically testified that the defendant was not the person who caused the accident or his injuries, Mark and Jorge decided not to call any witnesses in their case-in-chief and rested immediately after the plaintiff rested. In closing, the jury was given the choice to believe the plaintiff and grant a defense verdict or believe the defendant and grant a nominal amount for damages, if any. The jury believed the plaintiff and entered a defense verdict.
