Pete Skiko (Of Counsel-Chicago, IL) and Michael Meehan (Partner-Philadelphia, PA) co-wrote the sections of Georgia’s recent tort reform bill, Senate Bill 68, focusing on tort reform protection for security contractors. On behalf of our client, Pete coordinated with industry groups and their lobbyists, participated in a town hall hosted by Georgia Governor Brian Kemp, and during legislative negotiations met with Kemp’s legislative counsel. The new bill, signed by Kemp on April 21, 2025, requires that in order for liability to attach to security companies for the provision of “negligent security,” the security company must have actually assumed a duty to protect those on designated premises. In cases involving third-party criminal acts causing injury on a guarded premises, the new law also establishes (among other beneficial provisions) a rebuttable presumption that at least 50 percent of the total liability must be attributed to the third-party criminal.
