Jamie Winokur devotes her practice to complex litigation, concentrating on complex torts, medical and professional liability, and construction matters. Jamie’s ability to communicate consistently and effectively with her clients and with opposing parties, as well as her organizational and strategic skills, make her exceptionally qualified to handle matters from start to finish, searching for resolution opportunities whenever possible. Jamie was one of 20 nominated finalists who successfully completed Wilson Elser’s rigorous Mock Trial Invitational, through which our most successful trial lawyers impart their knowledge to those destined to join their ranks.

Jamie joined Wilson Elser with more than eight years of litigation experience with firms in Detroit, Michigan, and Charlotte, North Carolina, and she is licensed in South Carolina.

Over the course of her life, Jamie has traveled extensively, including visits to England, Belgium, The Netherlands, France, Switzerland, Italy, Vietnam, Thailand, Mexico, and Costa Rica. During law school, Jamie studied abroad in Fribourg, Switzerland, as part of a foreign exchange program with the University of Fribourg Law School and the University of Alabama School of Law. Areas of Focus

Complex Torts & General Casualty
The greatest percentage of Jamie’s practice involves complex torts and general casualty. In these matters, Jamie represents insurers and businesses who require representation for a variety of reasons. Because of this, Jamie’s practice is incredibly diverse and her breadth of knowledge in these types of claims is extensive.

General Liability & Professional Liability
The majority of Jamie’s prior practice was focused on general and professional liability, where she managed professional liability claims for doctors, nurses, and dentists, as well as complex torts and general insurance defense claims. Due to her level of experience in this area of the law, Jamie continues to concentrate her efforts in this capacity. She also is an integral part of Wilson Elser’s response team on active shooter cases at both residential and commercial properties.

Construction Litigation
Since joining Wilson Elser, another area of focus in Jamie’s practice is construction litigation. She frequently defends subcontractors in residential construction cases involving allegations of negligence and breach of contract by general contractors or individual homeowners.

Winokur & Clements Secure Dismissal, Excluded Plaintiff’s Experts in Prior Motion Hearing

Jamie Winokur (Partner-Charlotte, NC) and Peter Clements (Associate-Charlotte, NC) secured summary judgment on behalf of a rehabilitation facility in a medical malpractice case in North Carolina Superior Court. The plaintiff sought damages for injuries allegedly resulting from negligent post-surgical wound care, including claims of lasting harm and a resulting below-the-knee amputation. Central to the plaintiff’s case were expert witnesses intended to establish the standard of care and causation. Jamie and Peter moved to exclude these experts in a prior motion hearing, and with no admissible expert testimony to support essential elements of the plaintiff’s claims, the court granted summary judgment for our client just before trial, dismissing the case in its entirety.
