Matthew Lee (Partner-McLean, VA) defended a law firm in the Superior Court of the District of Columbia, Civil Division against allegations that the firm deviated from professional standards in failing to forward time-sensitive HHS documents, which prevented the plaintiff from challenging the HHS ruling excluding the plaintiff from Medicare reimbursement. Matt pointed to the fact that an Administrative Law Judge and the HHS Board of Appeals already affirmed the firm's client did provide the plaintiff with timely notice of his Medicare exclusion and noted the plaintiff failed to properly serve the firm's client. The court granted the motion to dismiss.
