Wilson Elser is often called upon by our carrier clients to serve as monitoring or supervisory counsel.
We provide analysis and evaluation of claim exposure, monitor defense developments and assist in negotiating the carrier’s settlement obligations. As coverage issues arise, we assess the relative merits of alternative resolution strategies, while ensuring that the carrier’s coverage obligations are fulfilled. Upon request, we also may participate at mediations or monitor depositions and trials. With specific regard to excess carriers, we ensure they are kept apprised of primary insurer developments so they may adjust reserves accordingly.
We may be asked to play a more active role as supervisory counsel, especially on behalf of major excess- or umbrella-level insurance carriers. These clients look to us to analyze the primary counsel’s day-to-day handling of litigation, including trial work, and to advise on likely exposures, resulting coverage issues and possible settlement positions.
