Jorge Ramirez (Partner-Las Vegas, NV) and Mark Severino (Of Counsel-Las Vegas, NV) obtained a complete defense verdict on behalf of a local mall in a premises liability action tried in the Nevada Federal District Court. The plaintiff claimed significant injuries after slipping on a liquid (spilled by an unknown patron) that had been on the ground for 13 minutes prior to her fall. In one of the first in-person federal trials since COVID-19 restrictions, the defendant argued it was not liable as there was no evidence the mall was negligent, its policies and procedures were not negligent, and there was no evidence it had notice of the spill. The jury deliberated only 40 minutes before returning a complete defense verdict.
