Eric Niederer handles health care liability, product liability, catastrophic loss and high-exposure matters in state and federal court. He has represented a variety of health care providers in litigation, compliance issues and Department of Public Health investigations. Additionally, Eric has represented national and international manufacturers, distributors and retailers in product liability and commercial actions, including medical products and FDA and CPSC recalls. He has written articles and lectured on health care, product liability and Connecticut civil procedure. Eric routinely handles catastrophic loss and wrongful death actions in a myriad of actions with direct day-to-day development, implementation and handling of the overall litigation strategy and activities in a variety of low-exposure to high-exposure cases up to and through trial, including appellate practice.

Eric is experienced in the defense of medical malpractice, product liability, wrongful death and high-exposure matters. He defends medical providers and facilities, and manufacturers, distributors, retailers and owners in product liability, medical device and commercial actions. Eric’s knowledge, abilities and effective representation have been recognized by industry leaders and organizations through speaking engagements, consulting, publications, awards and distinctions.

Areas of Focus

Product Liability
Eric has represented national and international manufacturers, distributors, retailers and product owners in product liability and commercial actions, including recall litigation in state and federal courts. He has represented medical device manufacturers and pharmaceutical companies in various matters, including FDA recalls. During his career, he has worked with national coordinating counsel for one of the largest international tool manufacturers in the world and assisted in the development of national and Canadian litigation guidelines.

Medical Malpractice & Health Care / Catastrophic Injury
Eric began his career as a paralegal assisting in the defense of medical malpractice, product liability, wrongful death and high exposure matters. Eric has defended a variety of health care providers, including doctors, physicians’ assistants, chiropractors, nurses, nurses’ aides, midwives, occupational therapists, physical therapists, licensed massage therapists and naturopaths, and other allied health professionals, as well as hospitals, nursing homes, assisted living facilities and other medical facilities in a wide variety of medical malpractice and health care liability cases. He is experienced in the representation and defense of medical professionals in actions against professional licenses by the Department of Public Health.

Toxic Tort / Asbestos
Eric is experienced in the area of toxic torts as well as matters relating to asbestos exposure in various contexts. He represents manufacturers and distributors as well as premises owners.

Representative Matters

Smith, Adm’r v. Mediplex of Westport, 273 Conn. 508 (2005). Appeal dismissed in client’s favor.

Bonsanti v. Newman (Conn. Super. Ct. 2006). Represented defendant. Case of first impression with decision in favor of our client’s position that write-offs by a medical provider pursuant to a contract between that medical provider and an ERISA plan beneficiary are reduced upon post-verdict motion for remittitur.
