Employment Counseling, Training & Litigation
Clients routinely seek Dean’s help navigating difficult personnel issues, managing employees with disabilities and medical leave needs, complying with wage-and-hour regulations, developing handbooks and policies, constructing compensation plans and negotiating executive compensation arrangements.  Dean’s clients also sought his guidance on risk mitigation and business re-opening protocols in the wake of the COVID-19 pandemic. 

Clients also call on Dean to train management and employees on a variety of subjects.  Dean has produced a number of online training programs, including state-mandated sexual harassment training that clients can deliver to employees virtually through the firm’s e-learning platforms. 

Dean also maintains a significant employment litigation practice.  He defends employers against such claims as breach of employment contract, discrimination and harassment, violations of disability and medical leave laws and workplace torts.  He frequently litigates individual, representative and class action wage-and-hour lawsuits alleging denials of meal periods and rest breaks, misclassifications of employees, non-payments of wages, off-the-clock work, unlawful commission and bonus plans, and violations of statutory pay provisions, including the California Private Attorney General Act.  Dean has successfully enforced employer-promulgated arbitration programs, secured restraining orders against employees involved in workplace violence, and prosecuted actions against employees engaged in unfair competition and misappropriation of trade secrets. 

Cannabis Law
Within the cannabis industry, Dean assists with business formations and corporate governance, supports licensing applications and modifications, advises on commercial transactions, mergers and acquisitions and fundraising, develops sound SOP’s and personnel policies and guides regulatory compliance in the growth, transportation, processing, production and distribution of cannabis products.  Dean also supports ancillary businesses, financial institutions and insurance companies working with cannabis companies by providing guidance on regulatory compliance, risk management principles, underwriting practices and policy forms. 

When disputes arise, Dean leverages the firm’s strength across multiple disciplines to effectively litigate commercial, products liability, professional liability, intellectual property and employment law claims. 

For employers of all types, Dean provides guidance on legalization’s impact on employment law issues such as job applications, drug testing, accommodating employees’ use of cannabis for medical purposes and cannabis as a cause or treatment for workplace injuries. 

Fair Housing & Discrimination
Dean has significant experience counseling clients and defending against litigation asserting discrimination under state and federal fair employment and housing laws. He has defended hotels and business establishments against claims of discrimination under the Americans with Disabilities Act and California’s Unruh Civil Rights Act. Rocco & DeWolfe Obtain Defense Verdict in Religious Harassment and Discrimination Case in Arbitration

Dean Rocco (Partner-Los Angeles, CA) and Jack DeWolfe (Associate-Los Angeles, CA) obtained a defense verdict on a religious harassment and discrimination case in arbitration. The plaintiff nurse alleged her employer, a health care facility, wrongfully denied her request for an exemption to its COVID-19 vaccine mandate and harassed her based on her asserted religious beliefs. Dean and Jack established that alleged comments at work did not constitute unlawful harassment, and the circumstances surrounding the employer's original denial of the exemption request, combined with its eventual reversal of that decision, did not constitute a failure to accommodate the employee's religious beliefs or provide grounds for the employee to quit and sue for constructive wrongful termination.

Rocco and Immordino Thwart Ad Agency’s Breach of Contract Claim

Dean Rocco (Partner-Los Angeles, CA) and John Immordino (Of Council-Los Angeles, CA), with the able assistance of paralegals Barry Lipsky and Joyce Marilyn, secured a defense verdict on behalf of two prominent ski resorts in Los Angeles County Superior Court. The case arose from an advertising services agreement the advertising agency claimed our clients breached by terminating it without sufficient cause or notice per contract terms. Our clients argued they terminated the agreement with good cause and sufficient notice, and that they could and would have terminated the agreement for other breaches discovered during the litigation. Dean and John argued the plaintiff should not be awarded damages given the evidence presented in the case and the breaches discovered during litigation. The jury found there was a breach of the contract, but not of the implied covenant of good faith and fair dealing, and also that plaintiff failed to establish damages. The net effect was a defense verdict for our client.

Rocco, MacManus and Wong Granted Summary Judgment in Breach of Employment Agreement Case

Dean Rocco (Partner-Los Angeles, CA), Carlos MacManus (Of Counsel-Los Angeles, CA) and Trevor Wong (Associate-Los Angeles, CA) defended a national property management company against claims it breached an agreement to compensate an agent for referring properties for management.  The agent sued, claiming the company was required to continue managing properties, accepting referrals and paying her fees, and she sought damages based on alleged unpaid fees under the agreement.  The team submitted a motion that parsed a complicated record of facts and asserted nuanced contract law arguments, and convinced the trier of fact the company was not precluded by contract from terminating existing property management agreements nor required to accept new referrals from the plaintiff.
