Ian Stewart has defended complex litigation in state and federal courts for more than 20 years with a focus on product liability, complex general casualty, cannabis law, transportation and marine claims, data privacy and security, and intellectual property litigation. Ian is co-chair of the firm’s Cannabis Law practice and a member of the Information Governance Leadership Committee.

Ian is committed to client communication and cost-effective litigation management. He is a proponent of efficient claim resolution and Legal Project Management. Ian goes out of his way to ensure that he understands his clients’ business and goals so that an agreed strategy can be identified and implemented at the outset of any litigated matter.

Areas of Focus

Complex Tort & General Casualty, Transportation and Product Liability
Ian frequently defends security and premises liability matters for hotels, commercial property owners, condominium associations and retailers. He has represented fleet owners, including motor carriers, armored trucks and taxi/limousine companies. He regularly defends maritime/marine claims, as well as general liability matters involving sports and school-related risks.

Ian has successfully defended a variety of product liability matters involving products manufactured in the United States and abroad. These include recreational vehicles, industrial machinery, drugs and medical devices, nutritional supplements, amusement park rides, sporting goods and consumer products. Ian regularly defends consumer class actions involving product liability and warranty issues. He currently serves as national chair of the Claims and Litigation Management Alliance’s Product Liability Committee.

Cannabis Law
As co-chair of the firm’s Cannabis Law practice, Ian leverages his 20 years of legal experience to help clients navigate the challenging new risk management, business practices and insurance landscape presented by the rapidly developing area of Cannabis Law. Ian helps traditional and new organizations prepare for regulatory changes and liability trends whether dealing with regulatory compliance, product liability risks, defense of false advertising and unfair competition claims, professional liability risks, brand protection and obstacles to protecting intellectual property, assisting startups with novel risk management methods, or insurance coverage problems created by conflicting state and federal laws.

Ian works with licensed cannabis operators to comply with their obligations under the law and to develop risk management best practices.  He regularly consults with insurance companies to assist with cannabis-related underwriting practices and the development of new policy forms. Ian is currently vice chair of the Insurance Committees of the National Cannabis Industry Association and the California Cannabis Industry Association.

Cyber Liability
Ian is a member of the firm’s Information Governance Leadership Committee and a Certified Information Privacy Professional (CIPP/US). He has responded to numerous data breaches for companies including retailers, medical providers and professional firms. Ian counsels clients on evolving privacy threats, including the collection, use, retention and destruction of data. He also defends data privacy class-action litigation and litigated matters involving invasion of privacy, right of publicity and statutory consumer claims.

Professional Liability
In the professional liability area, Ian focuses on the defense of architects/engineers and miscellaneous specialty risks. He performs contract reviews for design professionals and has been designated as the point of contact by two insurance companies for their contract review programs.

Intellectual Property
Ian’s intellectual property practice focuses on litigation involving trademark and trade dress infringement claims, trade libel, trade secret, unfair competition claims, internet domain disputes and license agreements.
