Appeals
Wilson Elser's Appellate practice has successfully handled thousands of appeals in federal and state courts throughout the United States. Known for clear and persuasive briefs, strong oral advocacy and sensitivity to cost containment, our appellate attorneys provide forceful arguments and innovative resolutions to meet our clients’ needs. In concentrating on the complex, highly technical and constantly evolving discipline of appellate procedure, we have the experience needed to plan and execute the most effective post-trial and appellate strategies.

Critical Motions
Because successful appeals begin long before trial, our appellate attorneys often become involved in early case evaluation and critical pleading-stage and dispositive pretrial motion practice.  Focused on our clients’ businesses and litigation goals, our team regularly collaborates with Wilson Elser trial teams and others to develop and implement case strategies that frame and preserve the legal issues from day one to best position the case for success on appeal.

Trial Support
Our appellate attorneys often participate actively at trial and are regularly called on to draft motions in limine, jury instructions and post-trial motions. Through trial monitoring — either on-site or remotely — our team is able to provide objective, real-time evaluations of appellate issues and help to ensure error and issue preservation for appellate review. Through this collaboration with trial counsel, we develop a record that puts our client in the strongest possible position on appeal.

Litigation Coordinating Counsel
When faced with numerous lawsuits in multiple jurisdictions pertaining to the same issue, event or product, clients often look to Wilson Elser for litigation coordinating counsel services. Our appellate attorneys work to build a body of consistent case precedent across jurisdictions with the goal of rendering our client a more formidable adversary. Specifically, we help ensure the quality and consistency of issues briefing at the trial and appellate court levels; work with trial counsel to develop a uniform approach to overall litigation strategy; implement a coordinated multijurisdictional appellate strategy; develop a brief bank on recurrent issues for the client’s use nationwide; and prepare amicus submissions where warranted.
